Terms of Service

Effective July 2, 2026 · Provided by Wag Media, LLC (“Company,” “we,” “us”). Covers the public calendar, the calendar feeds, and the Buffalive app.

1. What this is

This site, its calendar feeds, and the Buffalive app offer a compiled listing of Western New York concerts and live-music events, provided free for your personal, non-commercial convenience. Parts of the service (the Buffalive app) are currently in private beta and require an account. Some listings may be paid placements and are labeled as sponsored. By using the site, the app, or subscribing to a feed, you agree to these Terms. If you don’t agree, don’t use the service.

2. Accounts and personal feed links

Beta access uses a sign-in link sent to your email address. Your account includes a personal calendar-feed link; keep it private, as anyone with the link can read your feed. We may revoke feed links or suspend accounts that are shared, abused, or used in violation of these Terms, and we may end or modify the beta at any time.

3. The information is not guaranteed

Event dates, times, lineups, venues, prices, and map locations are compiled from third-party sources, including Jeff Miers’ Where the Bands Are: Summer Music Series Guide, publicly available listings, and information sent to us. Details change, get cancelled, or may simply be wrong. We do not verify, and do not warrant the accuracy, completeness, timeliness, or availability of any listing. Confirm details with the venue or promoter before relying on them.

4. Event information you send us

If you send us event or venue information — through the “Submit an event” form, the “Feature my show” form on the advertise page, the venue-suggestion form, or by email — you confirm the information is accurate to your knowledge and that you have the right to share it, and you grant the Company a nonexclusive, royalty-free license to publish, edit, format, distribute, and remove the listing across the site, app, and feeds. Everything is reviewed by a person; we may decline or remove any listing for any reason, and publication is not guaranteed.

5. Sponsorships and featured placements

Paid placements — featured shows, category, digest, presenting, and naming sponsorships — are labeled in the product. Sponsorship payments are made directly to the Sportsmen’s Americana Music Foundation, a 501(c)(3) not-for-profit corporation, not to the Company. Featured placement is subject to review and availability: up to two featured shows per date, with the top position going to the first completed payment. Requests are confirmed by email before any payment is made, and if we decline a request you will not be charged. We may remove a placement that is unlawful, misleading, or inconsistent with the calendar’s purpose.

6. Provided “as is”

The site, app, and feeds are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, and without any guarantee that the service will be uninterrupted, secure, or error-free.

7. Use at your own risk; no harm to your systems

You access and use the service at your own risk. To the maximum extent permitted by law, neither the Company nor the Sportsmen’s Americana Music Foundation is liable for any damage to or malfunction of your device, software, calendar application, accounts, or data, or for any data loss, corruption, security incident, or service interruption, arising from or related to your use of the site, app, or feeds.

8. Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or losses arising from your reliance on any listing or from attending, missing, or purchasing tickets to any event. The service is provided free of charge; the Company’s total aggregate liability for any claim relating to the service will not exceed US $0.01.

9. Third-party links and services

The service links to and depends on third parties we don’t control — including Jeff Miers’ Substack, venue and ticketing sites, your calendar provider (e.g., Apple or Google), map data and tiles from OpenStreetMap displayed in the app’s map view, and Google Maps or Apple Maps if you use a directions link. We are not responsible for their content, availability, or practices, and your use of them is governed by their terms, not ours.

10. Intellectual property and attribution

Concert information is compiled from Jeff Miers’ Where the Bands Are: Summer Music Series Guide, public sources, and information sent to us; event names, artist names, and venue marks belong to their respective owners and are used for identification only. The compiled calendar, the Buffalive name and mark, and this site are provided for personal use; you may not scrape, resell, or commercially redistribute them without our written permission.

11. Acceptable use

Use the service only for lawful, personal purposes. Don’t attempt to disrupt, overload, probe, or gain unauthorized access to the service or its hosting, and don’t use the “Submit an event,” “Feature my show,” or venue-suggestion forms to send spam, false listings, or unlawful content.

12. Changes

We may modify, suspend, or discontinue the service or these Terms at any time without notice. Your continued use after a change means you accept it.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Erie County, New York.
